Terms & Conditions

• Custom Your Pickleball: trade name of Bodegraven & Wilffert Enterprise, established in the Netherlands.
• Customer: the natural or legal person who enters into an agreement with Custom Your Pickleball.
• Product: a custom pickleball paddle, personalised to order according to the customer's specifications.
• Agreement: any arrangement between Custom Your Pickleball and the customer for the delivery of a product.

These terms apply to all offers, orders and agreements of Custom Your Pickleball. Deviations are only valid if they have been agreed in writing.

An agreement is concluded as soon as the customer has approved the digital proof and payment has been received. For business orders, approval of the quote and proof is sufficient, after which delivery takes place on invoice.

Custom Your Pickleball sends a digital proof within 24 hours of the order. Production only starts after the customer's explicit approval of the proof.

All prices are in euros and include VAT, unless stated otherwise. Prices may be adjusted without prior notice, but always apply to orders already placed and confirmed.

For private customers, payment in advance via the offered payment methods applies. For business customers, payment on invoice within 14 or 30 days applies, depending on the agreement.

Custom Your Pickleball aims for a delivery time of no more than 7 business days for private orders and 7 to 14 business days for business orders, counted from the day on which the proof was approved and (where applicable) payment was received.

Delivery is carriage paid within the Netherlands. For deliveries to Belgium or Germany, adjusted shipping costs apply which are discussed in advance.

Custom Your Pickleball is not liable for delays caused by external parties such as carriers, unless there is intent or gross negligence on the part of Custom Your Pickleball.

Because all products are personalised to order for the customer, they are excluded from the statutory right of withdrawal on the basis of article 6:230p sub f of the Dutch Civil Code.

For this reason, the proof approval is a critical step. Custom Your Pickleball handles the proof with extra care and gives the customer the opportunity to request changes before production starts.

Custom Your Pickleball provides a 12-month warranty on material and printing defects under normal use. Normal use means: use that fits the nature of the product (recreational pickleball playing sessions).

Excluded from the warranty are:

• Wear due to intensive use.
• Damage due to improper use, accidents or misuse.
• Damage due to insufficient maintenance.

Custom Your Pickleball is only liable for direct damage resulting from intent or gross negligence on the part of Custom Your Pickleball. The liability is in any case limited to the amount of the invoice value of the relevant order.

Custom Your Pickleball is not liable for consequential damage, lost profit, missed savings or other indirect damage.

The customer warrants that they are entitled to have the supplied design or logo printed on the product. Custom Your Pickleball is not liable for third-party claims regarding the intellectual property of supplied files.

Custom Your Pickleball may use images of delivered products for its own marketing, unless the customer objects to this in writing in advance.

Complaints about a delivered product must be reported within 7 days of receipt via info@customyourpickleball.com. Custom Your Pickleball responds within 5 business days and strives for an appropriate solution.

All agreements are governed exclusively by Dutch law. Disputes are submitted to the competent court in the district where Bodegraven & Wilffert Enterprise is established.
